Sanderson Machines Terms and Conditions of Sale

1. Pricing

 All prices on this website are in USD (United States Dollars) by default. If you require an invoice in a different currency, please contact us directly.

No sales tax is added as we are exporting from New Zealand, you will receive an invoice for payment once you place your order online.

Discounts may be applied at the discretion of Sanderson Machines; we also reserve the right to amend prices if and when it is deemed necessary.

2. Payment

Once you have placed an order online, we will review this and send an invoice for payment including shipping costs. This invoice will include bank details for wire transfer.

Standard payment terms are: payment in full prior to delivery of goods, otherwise payment is due as per the terms set out on the invoice.

Title or ownership of the goods remains the property of Sanderson Machines until paid in full.

3. Delivery

Delivery costs will be calculated when we receive your order, and will be included in your invoice for payment.

We will use the appropriate carrier for the weight and size of your shipment, if you have a carrier with your own account number that you would like us to use please advise us when placing your order.

In the event a shipment gets lost or damaged in transit, please advise us as soon as possible with photographs so we can file a claim with our carrier.

We have no control over the transit time once your shipment leaves our facility, if you believe the shipment is taking longer than expected then please contact us and we will follow this up.

4. Warranty

In the event that we supply incorrect or defective tooling, please contact us as soon as possible so we can send the correct replacement.

Warranties will be granted on a case by case basis. The warranty is subject to fair wear and tear and correct use for their intended purpose.

The warranty does not apply in the following cases:

·         Where the goods have been subjected to any misuse, lack of maintenance, servicing, or handling which is contrary to or outside normal use.

·         Where the goods have, (without our prior written consent), in any way been altered, modified or tampered with in design or construction by the customer.

·         Continued use of any goods after any defect becomes apparent to the operator or user.

·         If in the seller’s opinion any defects are of a cosmetic or non-substantial nature.

5. Claims/Returns

All claims and missing items are to be reported within 14 days of receiving the goods. Indent and procured items cannot be returned for credit unless defective or incorrectly supplied.

6. Specification Accuracy

Every effort has been made to ensure the specifications and features of goods on the website and quotations are correct and up-to-date. However, Sanderson Machines does not guarantee that all information on the website is up-to-date, and reserves the right to modify those specifications without further notice. If any specifications are considered critical to the customers purchase, please notify Sanderson Machines so that we can arrange for these specifications to be confirmed to you in writing.

7. Limitation of Liability

Sanderson Machines shall not be liable for any loss of profits, or any consequential indirect loss, or damage of any kind arising directly or indirectly from any breach of the seller’s obligations or in tort. Where Sanderson Machines is liable to the customer, the maximum cost of any liability shall not exceed the value of the goods or services provided. If anything in this agreement is unenforceable, illegal or void, it is severed and the rest of this agreement remains in force.

8. Privacy Act 1993

The customer permits the seller to collect, use and retain any information concerning the customer, for the purpose of assessing the customer’s credit worthiness, to enforce any rights under this contract or for the marketing of any goods or services provided by Sanderson Machines. The customer permits the seller to disclose information obtained to any person for the above purposes.

9. Jurisdiction

The contract shall in all respects be deemed to be a contract made in New Zealand and the validity, construction and performance of the contract shall be governed by New Zealand law.

10. Acceptance

Any instruction received by Sanderson Machines from the customer for the supply of goods shall constitute acceptance of these terms and conditions. The seller reserves the right to review and amend these terms and conditions at any time.
